Ik heb een probleem met uw "kettingredenering" volgens dewelke het centraalstation in Antwerpen "slechts middels geweld tot stand is gekomen".

Dat station is NIET tot stand gekomen via geweld, maar wel via de inspanningen van 'Belgische' arbeiders in de 19de eeuw in combinatie met (a) staal dat geproduceerd werd in Belgische/Europese (?) staalbedrijven en (2) 'brains' van Belgische ingenieurs en managers. De totstandkoming van dat gebouw heeft niets DIRECT te danken aan (On)"vrijwillige" arbeid uit "Kongo-vrijstraat".

Het is natuurlijk wel zo dat de geschiedenis vol staat met "geweld, staatsdwang, afpersing, enz...", en dat zal zo wel altijd blijven, gezien de menselijke natuur. En dat "geweld, enz..." heeft ook een zekere invloed gehad op "eigendomsverhoudingen" in het verleden, ondermeer binnen de Belgische staat. Maar, men kan geen concreet of reeel kapitaal (zoals een spoorweg-met-gebouwen) in Belgie gaan verbinden met 1 enkele vorm van "geweld" in het verleden (en dan nog wel in Kongo). Er hebben intussen immers ontelbare andere vormen van "geweld" plaats gegrepen die ook een impact op (steeds tijdelijke) eigendomsverhoudingen hebben gehad, zowel onder Belgen als tussen belgen en buitenlanders, die het onmogelijk maken van een direct verband te leggen tussen Leopold-in-Kongo en de NMBS.

Het centraal station werd gebouwd door Belgische arbeiders en 'brains', en als het vandaag eigendom is van de staat, dan is er geen redelijke reden waarom de staat het niet zou kunnen privatiseren met de bedoeling van dat stuk meer 'rendabel' en nuttig te maken voor de maatschappij. Maatschappijen kunnen 'vooruitgaan' op velerlei manieren, en men kan redelijkerwijze veronderstellen dat de komst van de spoorwegen (met stations enz...) ook in Belgie zou gebeurd zijn ongeacht wat leopold in Kongo in de 19de eeuw zat te doen, just gelijk in de buurlanden van Belgie. Men zou zelfs redelijkerwijze kunnen zeggen dat dat Leopoldistisch of Belgisch "geweld" de aanleg van spoorweg in Congo mogelijk heeft gemaakt.

Kortom, geweld in het verleden, evenmin als eigendomsverhoudingen in het verleden, leveren geen direct verband met contemporele eigendomsverhoudingen. Er spelen talloze andere (en veel belangrijkere of meer-determinante) factoren mede die de huidige bestaande eigendomsverhoudingen kunnen verklaren dan specifiek "geweld" uit het verleden.

All sociology, as we just said, has hitherto attempted to deduce the circumstances of our present society solely from the internal evolution of a primitive society in which EQUALITY and FREEDOM prevailed. Scientifically this deduction carries, since Adam Smith's day, the name of the "Law of Previous Accumulation." It maintains that the primitive society of FREE and EQUAL members has witnessed a greater and greater differentiation merely by the influence of the natural differences in human endowments. The clever, industrious, sober and saving ones accumulated wealth, and out of these economic differences in wealth there developed gradually the social and political differences of rank, of the social order and of classes.

This theory may certainly be said to be UNTENABLE. It can be disproved deductively, although we have not the time to demonstrate this here. The inductive demonstration from the facts of history is sufficient for its refutation. Wherever the origin of a state-society is known to us at all, there we know with full certainty that it originated through the subjection of one people by another and conquering people. It seems appropriate here to consult English history for an example. These Islands probably contained a primitive people of unknown language and race who were conquered by the Celts. The latter were subjected by the Saxons and Danes and these in turn by the Normans. In every case the conquering group set itself up as a nobility over the group which it had subdued. In other words, the social classes were formed everywhere not by slow differentiation occasioned by economic relations, but by a single stroke of power based on the political relations between barons and serfs, lords and vassals or slaves, those with full rights and those with lesser or no rights.

Om ietwat verder aan te knopen bij uw aanmerkingen omtrent arm en rijk, en dergelijke meer, het volgende: de (op de praxeologie gefundeerde) libertarische rechtstheorie gaat namelijk ook uit van een soort hypothetische natuurtoestand van waaruit men dient te vertrekken (vandaar het belang van dat begrip 'epochè' - reductie/abstractie - welk ik echter misschien later in een uitgebreidere bijdrage verder zal exploreren). Ook iemand als Hans-Hermann Hoppe, een van de voornaamste 'stamvaders' van de libertarische argumentatie-ethiek, gaat eigenlijk uit van de vooronderstelling dat (economische!) 'eigendom' noodzakelijk is om je eigen leven in stand te houden. Dit zou inderdaad, à la Van Ornum, inhouden dat je slechts zoveel eigendom zou hebben als strikt noodzakelijk om je eigen lijf en leden in stand te houden. Althans in zo'n hypothetische natuurtoestand. Maar vanaf daar stopt de gelijkenis dan ook, denk ik. Want het is helemaal niet de bedoeling van een libertarische rechtstheorie om materiële gelijkheid te creëren - zij maakt hier zelfs abstractie van! - maar wel om eigendomsrechten te funderen. En daar waar in de natuurtoestand iedereen dus met min of meer dezelfde kansen start, staat natuurlijk niets in de weg dat op termijn materiële ongelijkheid ontstaat, door aankoop, ruil, transactie, erfenis, enz. Zolang het non-agressiebeginsel wordt geschonden, is er alleszins geen probleem.

Het probleem, en dit is dan natuurlijk empirisch-historisch van aard, is dat de bestaande eigendomsverhoudingen slechts gedeeltelijk op vrijwillige transacties berusten. Zo zou het bijvoorbeeld perfect mogelijk zijn de uitbating van het centraal station hier in Antwerpen (als inwoner van kan ik me geen ander voorbeeld indenken, maar het is dan ook al na middernacht ;-)) te privatiseren, en dan kan men zeggen dat Antwerpen-centraal in handen is van privé-onderneming Y. Maar die onderneming heeft het station wel gekregen uit handen van de NMBS en dus de staat, die het op zijn beurt heeft uit handen van een knettergekke Belgische 19de eeuwse vorst, die de investeringen in dat prachtige centraal station ("une petite belle gare" volgens de monarch in kwestie...) heeft bekostigd middels opbrengsten uit de Kongo-Vrijstaat, en u weet wellicht ook maar al te goed onder welke "vrijwillige" omstandigheden de werknemers daar arbeid dienden te verrichten. Kortom, uit deze kettingredenering zou dan volgen dat onderneming Y GEEN rechtmatig eigenaar is van het centraal station, omdat deze slechts middels geweld tot stand is gekomen. En op analoge wijze zijn zowat alle beschavingen in de wereld en hun eigendomsverhoudingen doorheen de eeuwen tot stand gekomen middels geweld, plundering, staatsdwang, verovering, afpersing, bedreiging, en noem maar op. Louter deontologisch gezien is de enige oplossing dus een terugkeer naar zo'n natuurtoestand, waarin we 'tabula rasa' terug zouden beginnen. En als u mij dan zou beschuldigen van radicaal, extremistisch utopisme, bent u volledig terecht; maar vanuit pragmatisch meer praktijkgericht standpunt bekeken, moet ik u het antwoord helaas schuldig blijven.

Geachte Pierre Plum,

Om vooreerst te antwoorden op uw eerste twee opmerkingen/vragen (dus nog voor dat lange citaat er ineens tussenkwam):

1) Misschien dat ik ietwat te onnauwkeurig ben geweest met het begrip 'ruil' te hanteren, omdat een strikte definitie van ruil inderdaad de afwezigheid van geld als intermediair middel vooronderstelt. Wellicht ware een term als 'transactie' dus adequater geweest. In wezen is er dan echter absoluut geen verschil tussen de veehandelaar en de molenaar die bijvoorbeeld een koe verhandelt tegen een zak graan enerzijds; en een juffrouw die een nieuwe outfit van Prada koopt met een kredietkaart aan de anderzijds: in beide gevallen is het noodzakelijke voorwaarde dat beide partijen pas tot transactie overgaan indien hun beider situaties erop verbeterd worden.

- Uw tweede vraag hangt nogal samen met uw laatste, na het citaat van de (eerlijk gezegd, onbekende) Van Ornum omtrent het eigendomsprincipe. Gewoon een naambordje plaatsen op een eiland en zeggen: "dit is van mij" is absoluut geen voldoende voorwaarde om van een geldig eigendomsrecht te kunnen spreken. Los van de vraag of grond tot eigendom kan gemaakt worden (dit is een zaak waar ik zelf maar geen eenduidig standpunt over kan stellen, maar dit doet nu even niet terzake), is eigendomsrecht 'sensu lato' alleszins een intersubjectief gebeuren. Vandaar dat, hoe dan ook, Lockes idee van 'iets bewerken met je eigen arbeid' gewoonweg ridicuul. Men kan natuurlijk wel spreken over 'eigendom', niet in de juridische zin van het woord, maar in de economische: Robinson Crusoë (een ware held uit de praxeologie!) kan perfect land bewerken, vruchten plukken en gebruiken, maar eigendom in de juridische zin van het woord heeft hij niet, want er is niemand anders ten aanzien van wie hij zijn rechten kan doen gelden.

Maar het feit dat er economische actoren en economische goederen bestaan, dat kan perfect praxeologisch beschreven worden, zelfs zonder het instituut van private eigendom alsdusdanig (een "franciscaner economie", als het ware). Het gebruik van goederen op economische basis is alleszins noodzakelijk voor het instandhouden van het eigen menselijk leven, dat kan niet ontkend worden. Maar van een economisch recht ook een eigendomsrecht claimen is een non sequitur (iemand als Ludwig von Mises bezondigt zich daar bijvoorbeeld constant aan doorheen zijn, voor de rest, briljante oeuvre), zoals de marxisten terecht hebben aangewezen. Maar het is vervolgens de taak van de rechtsfilosofie, op basis van het praxeologische idee van de schaarste (zonder schaarste zou het immers onzinnig zijn een theorie van het 'mijn en dijn' te willen ontwikkelen) en de idee van het handelen dat vervolgens de stap van economisch gebruiksgoed naar (mogelijk) privaat bezit van dat goed maakt, en maakt gebruik van een logisch-deductief systeem (ik weet ook maar al te best dat vele mensen de wetten van de logica aan hun laars lappen en maar al te vaak niet redelijk handelen, maar dit is geen zorg voor een filosofie, die een duidelijk welomlijnde norm - waarnaar gestreefd kan worden - naar voren poogt te schuiven!) om alle mogelijke intersubjectieve verhoudingen na te gaan. Zoals ik, zij het kort, heb proberen aan te tonen in mijn artikel is alleen die norm die private eigendom over lichaam én (niet-gewelddadig) verworven goederen veronderstelt, gevrijwaard van performatief-dialectische contradicties, en beantwoordt zij tevens aan het criterium van universaliseerbaarheid. Ook wat dat betreft is dit dus een gemeenschappelijk kenmerk met de praxeologie, namelijk dat zij a-historische en transculturele normen voorschrijft. Uw voorbeeld over de slaaf is dus tamelijk irrelevant: zij vormt een pertinente schending van het vrijheidsbeginsel (inderdaad, zij is dus pervers!)

The way William Henry Van Ornum critizes the concept of propriety, is far beyond the reach of praxeology, I believe.
He is an utmost ethical thinker, and reduces the concept of propriety to 'what one really can occupy'.So everyone can occupy one house, and a limited piece of land...persons who possess more than they can occupy are robbers in his view.This is indeed an interesting question to debate...but i don't believe praxeology can be helpfull in
answering it.
As far as I can see praxeology is doing verry well, in describing the essential qualities of archetypical human-interactions, but abstains from value judgements.
For praxeology there is no difference between selling a slave
from selling a donkey on a market.

In het laatste luik van je artikel, doe je een poging om via universele principes de praxeologie toch een ethisch impact te geven.Ik kan je redenering hierin wel volgen, maar ik weet niet wat je zienswijze concreet inhoudt voor de huidige situatie hier en nu. Met name wat is de impact van je intersubjectieve ethica in een maatschappij waarin de ene rijk geboren wordt, en dus over alle mogelijke middelen beschikt om te doen waar hij zin in heeft, en de ander die in armoede geboren,zijn leven lang zal moeten kampen met beperkingen allerhande ,en vaak tegen zijn zin allerlei jobs zal moeten aanvaarden om het hoofd boven water te houden.
Is deze cultureel geërfde situatie, iets dat door toepassing van je ethisch intersubjevtieve ethiek, geleidelijk moet evolueren naar een grotere gelijkheid?
Ben je ook akkoord met Van Ornum dat het persoonlijke bezit niet meer mag zijn dan wat men persoonlijk kan bewonen of zinvol bewerken?

Suppose we take a little closer look at the rights of property! If they depend upon the law, as they most certainly do, and if the law is the expression of the will of the people, (a pure fiction) then the people may, and will change it, when they change their will, which they are liable to do at any time; or they may repeal it altogether. And they are just as competent to abrogate it, if they choose, in any other way, without taking the trouble of a formal repeal. But if law is the expression of the will of a few favored ones who hold special privileges, called monopolies, and who control the courts, legislatures, and administrations in secret and subtle ways for their own advantage, which is certainly the case, then it is not entitled to even this consideration. In either case the people have a perfect right to change it in part, or in whole, as they see fit; and they cannot be accused of violating any proper code of morals, whatever may be the result of the change. If the morals depend upon the law, and the people make the law, then the morals must change when the people change the law. But if the morals depend upon the law made by monopoly, in the interest of monopoly, they are but false morals at best, and are not binding upon the conscience of any man. Webster defines property as "that which is peculiar to any person, that which belongs exclusively to an individual; that to which a person has a legal title, whether in his possession or not; thing owned".

According to that, in order to know what property is, one must be familiar with the laws of property at the time and in the place where the inquiry is instituted, or determined. The answer to the question to-day might not be a correct one to-morrow, because the law might change. ... Property has two sources, or bases. One is in nature, and the other is in the
law. One is fixed, and the other changeable. One enforces itself unless interfered with by the other, while the other requires courts, juries, police-men, detectives, militia,armies, navies, politicians, and taxes to enforce it, and then it doesn't succeed very well.

Natural property is what would be recognized as property even if human law were entirely abolished. Examining the subject, we find three things necessary: the first is, the person, because there can be no possession without a possessor, second the thing, or subject which is possessed; and third, the condition of possession; that is, occupation.

In the absence of law I am free to go to nature and produce whatever pleases my fancy. I
will not stand idle in want, while all nature invites me to come and take freely. There is no law to take the product of my labor from me in taxes, and if a landlord claims a share, I will laugh at him, because he cannot call the law to his aid to enforce his claim. ... In a community where all have an equal show — perfect freedom — there is no need of a law to punish crime, for there will be no crime to punish where there is no organized force in society capable of overcoming all opposition, and compelling obedience: no power sufficiently strong to systematically violate the rights of individuals. ... There being no laws of property, property has no special rights, and consequently the possessors of property have no more power than those who have none (if we can conceive of there being any such under those conditions.) Property, conferring no power, can bring no distinction nor impart any influence; so that no one will seek it for those purposes. I said that there are three things necessary to the condition of natural property. The first two are obvious enough; but the third requires a little consideration. Why do we say that occupation, or possession, is a requisite? If, in the absence of law, I am in possession of a thing, and there exists no organized force to take it away, I may fairly, in nature, be said to own it. It is the natural state of ownership. I may part with it to another; but by so doing, I abandon my ownership, because there is no natural means whereby I can compel him to restore it. If he does so, it is of his own free will, and of the same nature as my abandonment to him. In the absence of any law of property, I may lay claim to any number of things which may be in the possession of another, but as I have no possession, and as there is no organized force which I can summon to my aid to get possession, there is no way in which I can enforce my claims; and consequently I have no natural property in those things. With possession as a necessary condition for property, the oppression of one man by another becomes impossible. No man can actually possess more than about so much. If one were to enclose a large tract of land, more than he could immediately use, and others needed that land, they would take it, irrespective of his claims.

-In het voorbeeld dat je geeft van ruilhandel, is de koper ook de verkoper, want hij ruilt iets voor iets anders.Hij koopt iets en verkoopt iets.Als geld een rol gaat spelen in de handel, heb je een eenduidige koper en een eenduidige verkoper.Die betaalt met geld is de koper, die het goed afstaat voor geld is de verkoper.
De ruilhandel zoals die bestaan heeft in primitieve samenlevingen is m.i. dan ook niet goed te vergelijken met de op basis van geld lopende handel, zoals wij die kennen.
Om het in fenonemenologische termen uit te drukken: door de introductie van geld ontstaat een nieuwe economische situatie waardoor begrippen als 'koper' en 'verkoper' hun zinsveld krijgen.
Buiten dit zinsveld zijn die begrippen niet operationeel.

-In je tekst gebruik je het begrip 'eigendom' op een wel zeer intuïtieve manier.Als ik een naambord plaats op een onbewoond eiland, is dat eiland dan mijn eigendom? Nu niet meer, aangezien de aarde al mooi verdeeld is onder staten, zodat een individu geen nieuw land meer op door het plaatsen van een vlag of naambordje kan inpalmen.Wat is volgens de praxeologische school de omschrijving van eigendom los van alle accidenten, historische toevalligheden, morele normen enz?
Is je eigen lichaam je persoonlijke eigendom? Kennelijk niet altijd, gezien er slaven bestaan, en bestonden, die zelfs geen meester zijn of waren over hun eigen lichaam. Of moet men hier toch een normatieve factor inschakelen, en beweren dat slavernij eigenlijk een 'pervers' gegeven is?
Ik zie niet in hoe men met de praxeologische methode in deze verder komt.

Het algemene is NIET het transcendentale wezen van individuele dingen; het is steeds predicaat (gezegde), bestaat dus niet onafhankelijk van het individuele ding: het onderwerp.
M.a.w, het ware zijnde is NIET het algemene, maar het individuele.

Volgens Paul Van Schilfgaarde ("De logika van Aristoteles", 1944; 2e verm. druk, 1956) bezitten het algemene en de vorm geenszins dezelfde betekenis en is het een vergissing de 'vorm' te vereenzelvigen met het 'algemene'. In de geest van Aristoteles, gebruikt Van Schilfgaarde in zijn latere werken dan ook de term 'vormkracht' als hij het heeft over de 'vorm' in de zin van ousia.
